Out-of-State Owners

Managing a mineral interest from a different state usually means every county-clerk errand becomes a mail delay or a trip you can't easily make. We built our closing process around never requiring you to show up.

A large share of our sellers live nowhere near the county where their mineral interest sits, often because the interest came from a grandparent's land in a state the family left decades ago, or because they moved for work or retirement and simply never dealt with the paperwork that followed them. Distance shouldn't make a legitimate sale harder than it needs to be, and our process is built so it doesn't: notarization, document delivery, and payment can all happen without you setting foot in the county where the minerals are located.

The one thing distance does change is how much we lean on documentation instead of a courthouse visit, since we can't assume you'll be able to pull anything from the clerk's office in person.

Remote online notarization

Most states now permit remote online notarization, where a commissioned notary verifies your identity over a live video call and notarizes the deed electronically, and a growing number of counties accept deeds notarized this way for recording without issue. Where your state or the county's recording office doesn't yet accept remote notarization for real property, we arrange a local notary near you instead, which is usually a bank branch, a shipping store, or a mobile notary service, and we cover coordinating that so it doesn't become your errand to run.

What we pull from the county so you don't have to

Our title team works directly with the county clerk or recorder's office where your minerals sit to confirm the chain of title, verify the legal description, and check for any liens, judgments, or competing claims on record, all without requiring you to request anything locally. If a title question comes up that needs a specific document, like a prior deed with an unclear legal description or a judgment we need released, we handle sourcing it from the county rather than asking you to track it down from out of state. Some counties still keep older records only on paper, which just means our title work there takes a few extra days rather than requiring anything additional from you.

Coordinating around a decedent's out-of-state estate

Out-of-state ownership often overlaps with inherited interests, where the mineral tract sits in one state but the estate was probated where the decedent actually lived. If that's your situation, we may need documentation from both the domiciliary probate in your home state and, in some states, an ancillary probate opened specifically to convey the out-of-state real property. We'll tell you upfront if your file needs the ancillary step, since it's easy to assume the home-state probate alone covers everything when it doesn't.

Getting paid without a local bank trip

Closing funds move by wire or by check mailed to your address on file, and we don't require an in-person signing at any point in the process, including funding. If you're managing the interest on behalf of family members who are similarly scattered across different states, we can coordinate separate remote notarizations for each signer and consolidate everything into a single closing rather than requiring the family to gather documents through each other. We keep every signer updated on the same timeline so nobody in the group is left guessing where things stand.
